CHARLESTON â The West Virginia Supreme Court on Thursday temporarily blocked a newly appointed state lawmaker from assuming his duties while it considers a challenge to the legality of his appointment.
Republican Gov. Jim Justice announced Wednesday that he had picked Joshua Booth, a political neophyte and executive at a family-run road contracting firm, to fill the Wayne County seat in the House of Delegates. The chair of the county GOP committee, Jeff Maynard, went to court alleging Justice did not follow the law when he picked Booth over three other candidates put forth by local Republican officials.
The office was formerly held by Derrick Evans, who resigned after he was charged with illegally entering the U.S. Capitol with a mob of Donald Trump supporters Jan. 6. ....

CHARLESTON The West Virginia Supreme Court Appeals agreed Thursday to an expedited hearing to determine whether Gov. Jim Justice wrongly appointed a delegate and ignored a list of nominees by a county committee.
The state Supreme Court issued an order and rule to show cause in a mandamus case brought by the Wayne County Republican Executive Committee asking the court to require Justice to choose a replacement for former delegate Derrick Evans from a list of three qualified candidates sent to the governor on Jan. 14.
“Upon review of the petition and motion to expedite, the court is of the opinion to, and does, grant the motion,” according to the order from the high court released by John Bryan, attorney for the Wayne County REC. ....

CHARLESTON Gov. Jim Justice announced Wednesday the appointment of Wayne County Republican Joshua Booth to replace Derrick Evans, the former delegate who resigned after accusations of illegal entry into the U.S. Capitol on Jan. 6, even as a lawsuit challenging the governor’s selection is pending.
“He is being appointed and I’m making that appointment today,” Justice said Wednesday. “I feel very, very confident that Joshua Booth will do a wonderful job for the people of West Virginia.” ....
