A Georgia judge is facing an ethics complaint that accuses him of grabbing and pushing a shackled inmate who cursed at him.
Chief Magistrate Cary Hays III of Crawford County, Georgia, “physically assaulted an inmate while the inmate was handcuffed, shackled at the feet, and accompanied by a law enforcement officer,” the May 7 ethics complaint alleges.
The Georgia Judicial Qualifications Commission filed the ethics complaint Friday after it reviewed the video and spoke with witnesses.
The incident happened in December 2020. According to the complaint, the inmate was unhappy with Hays’ decision regarding bond during a first-appearance hearing. The inmate began cursing at Hays and continued to do so as he was led out of the conference room where the hearing took place. ....

A Georgia judge is facing ethics charges filed on Friday for allegedly assaulting a shackled inmate who he says cursed at him, and could be removed from his position.
Charges against the judge, Chief Magistrate Cary Hays III, who was sworn into office in January 2017, were filed last week by the investigative panel of the Georgia Judicial Qualifications Commission. The official charges claim that after Hays presided over the unnamed victim s first appearance hearing on December 18, he followed the inmate, who was shackled both at the hands and feet, into the hall. He then grabbed him and shoved him into a wall. ....

KNOXVILLE, Ga. (AP) A Georgia judge accused of assaulting an inmate who he said repeatedly cursed at him during a hearing is now facing ethics charges, according to a state judicial agency.
The Georgia Judicial Qualifications Commission’s investigative panel alleges Crawford County Chief Magistrate Cary Hays III followed the inmate into a hallway after a December 2020 first appearance hearing, then grabbed him and pushed him against a wall while the man was handcuffed and restrained at his feet.
The inmate was not identified.
Hays, who was sworn into office in 2017, told The Atlanta Journal-Constitution on Monday that he did not injure the inmate “in any way.” ....
