Australia: Northern Territory Labor government pushing harsher bail laws for children
In the latest of a series of “law and order” measures, the Northern Territory (NT) Labor Party government announced last month plans to introduce more stringent bail conditions for children, including those who have been convicted of petty offences. In this, Labor is collaborating closely with the Country Liberal opposition.
Chief Minister Michael Gunner outlined “tougher than ever” repercussions for children aged 10-17 who breach bail conditions or re-offend while on bail. The government also plans to increase the number of offences for youth where bail may not be granted. “Bail is a privilege, not a right,” Gunner provocatively stated. ....

‘Time for talking is over’: Legal profession responds to deaths in custody report

While major legal bodies have welcomed a new report into the high rate of Aboriginal deaths in custody, they have cautioned that the “time for talking is over” and urged the government to make changes and address systemic injustices immediately.
On the 30th anniversary of the Royal Commission into Aboriginal Deaths in Custody, a select committee has released a new report and called on the government to fully implement the 339 recommendations from the commission that have been “gathering dust”, including raising the age of criminal responsibility and expanding court powers. ....

The committee also determined that the Bail Act should be reformed to include an express consideration of Aboriginality as a provision to ensure people were not left on remand.
Aboriginal defendants are 20.4% more likely to be refused bail by police than non-Aboriginal defendants in similar cases, according to a recent NSW Bureau of Crime Statistics and Research (Bocsar) study of more than 500,000 bail decisions made in NSW between 2015 and 2019.
Guardian Australia’s Deaths Inside project found that, nationally, more than half (54%) of all Aboriginal people who died in custody between 2008 and 2021 were on remand.
The NSW committee recommended the urgent removal of hanging points in prison cells and urged the government to commit to a deadline for doing so. It cited the case of Tane Chatfield, who died in hospital two days after he was found hanging in his cell at the Tamworth correctional centre in September 2017. ....
