Impossible Foods' GMO plant-based heme received proper approval, court rules

The Food and Drug Administration acted properly when approving Impossible Foods heme ingredient soy leghemoglobin as a color additive, the U.S. 9th Circuit Court of Appeals ruled on Monday. The ruling means that the company can continue using the ingredient, which it says gives its plant-based products their distinct meaty taste.
The Center for Food Safety had appealed the FDA s approval to the courts in March 2020, arguing that the regulators did not use the proper standard ensuring there was convincing evidence that the ingredient would lead to no harm before approving it. The heme molecule in soy leghemoglobin is found in all living things, especially meat, but Impossible Foods makes its from genetically modified soy. ....

In a memorandum filed Monday, the Ninth Circuit denied a petition asking for a review of a Food and Drug Administration (FDA) order allowing Impossible Foods Inc., which produces meat substitutes, to include a genetically engineered color additive in its products. 
The plaintiff, Center for Food Safety, alleged in its January brief that the FDA’s approval of soy leghemoglobin, used to give the appearance that meat was bleeding so it more closely resembled meat, was not sufficiently tested and that the FDA did not use the appropriate standards when approving the substance. The product is reportedly produced using genetically engineered yeast. The plaintiff alleged that, since it is a new product that has not previously been approved for consumption, it should be held to a higher standard of testing.  ....

A federal appeals court upheld a Food and Drug Administration ruling to allow a plant-based food company to use a genetically engineered additive to redden its imitation beef products.
The three-judge panel of the 9th Circuit Court of Appeals ruled on Monday that the Food and Drug Administration “performed the appropriate analysis” in allowing Impossible Foods to use soy leghemoglobin as a color additive in its beef analog products.
The 2-1 ruling followed a lawsuit against the FDA, filed on March 18, 2020, by the food advocacy group Center for Food Safety, arguing that the agency employed a lower safety standard than required by law when it approved soy leghemoglobin, or “heme,” to be used in raw Impossible burger products sold in grocery stores. ....

May 4 (UPI) A federal appeals court has ruled Impossible Foods can use heme, a color additive, which the company says makes its plant-based burgers taste like meat.
The court in San Francisco upheld Monday the U.S. Food and Drug Administration s decision to approve soy leghemoglobin as a color additive in Impossible Foods plant-based burgers, Bloomberg reported.

Impossible Foods has marketed the genetically engineered soy protein as containing heme, an iron-containing molecule that helps its plants-based burgers taste like meat, by filling craving for iron. ....

Impossible Foods uses GM soy protein concentrate as its primary ingredient, while its flagship ingredient soy leghemoglobin - a protein that carries the iron-containing molecule ‘heme,’ which it says
