The reforms include a new user-friendly online portal for road traffic accident claims under £5,000 – simplifying the process and removing the need for expensive lawyers. They also introduce a ban on settling whiplash cases without medical evidence – a practice which has opened the door to fraudulent or embellished claims.

Details The Master of the Rolls as Head of Civil Justice has approved amendments to the Pre-Action Protocol for Personal Injury Claims Below the Small Claims Limit in Road Traffic Accidents (“the Protocol”). The Protocol was first published in the Schedule to the PAP Update, approved by the Master of the Rolls on 18th February 2021. The amendments come into force on 12 May 2021.
