Man who refused to pollute Monongahela River settles wrongful termination suit against municipal entities

PITTSBURGH – A wrongful termination suit from a man who claims he was fired from a water and sewer authority when he refused to dump raw sewage into the Monongahela River has settled litigation with the West Elizabeth Sanitary Authority and other entities.
Perry Payne first filed suit in the Allegheny County Court of Common Pleas on Aug. 11 versus West Elizabeth Sanitary Authority and West Elizabeth Borough, Union Township of Finleyville and the Borough of Jefferson Hills.
“Plaintiff began working for WESA in June 2013. In September 2019, WESA was in the process of trying to get a new processing treatment plant online. Around this time, the old plant was still online and it developed a processing issue. Plaintiff did everything he could to address and correct this processing issue, but it continued until about mid-January 2020,” Payne said. ....

Wright Twp. has yet to vote on contract with its police chief


Wright Twp. Police Chief Royce Engler has been working for nearly a year without a contract, but township officials are mum about the status of a new pact for the 42-year veteran.
At last week’s township supervisors meeting, supervisor Donald Zampetti asked why the contract was not on the agenda. Zampetti said it was his understanding an agreement on a new pact was reached in November. “Why haven’t we voted on this?” Zampetti asked.
Zampetti was told by board chairman Matthew Howton that the contract was a personnel matter and could not be discussed at a public meeting. Solicitor Jack Dean reiterated Howton’s position. ....

PITTSBURGH – A wrongful termination suit from a man who claims he was fired from a water and sewer authority when he refused to dump raw sewage into the Monongahela River is the burden of the West Elizabeth Sanitary Authority, according to Union Township.
Perry Payne first filed suit in the Allegheny County Court of Common Pleas on Aug. 11 versus West Elizabeth Sanitary Authority and West Elizabeth Borough, Union Township of Finleyville and the Borough of Jefferson Hills.

Preserve at Blue Ridge moving forward after Commonwealth Court decision


Commonwealth Court has upheld a decision by the Luzerne County Court that overturned Dorrance Twp.’s denial of the Preserve at Blue Ridge Trail’s application to build a planned residential community around the existing Blue Ridge Trail golf course.
The order, filed Monday, upheld the Dec. 12, 2019 decision of Senior Judge Kenneth W. Seamans, Susquehanna County, who was specially appointed by the Luzerne County Court.
The Preserve plans to develop approximately 135 acres of its 546-acre property as single-family dwellings on one acre lots. A planned residential development allows a developer to meet overall density and land-use goals without being bound by rigid zoning requirements such as minimum lot size and use categories. It also encourages preservation of more open space than traditional developments. ....
