Pittsburgh Water & Sewer says it's not at fault for diversion of storm runoff into plaintiffs' homes

PITTSBURGH – The City of Pittsburgh’s Water and Sewer Authority has denied it was responsible for the alleged defective design and failure to repair a deteriorating storm sewer culvert, which caused storm water runoff to flow into the plaintiffs’ homes.
Sandra C. Hill and Alan Ricketts first filed suit in the Allegheny County Court of Common Pleas on Dec. 7 versus the Pittsburgh Water and Sewer Authority. All parties are of Pittsburgh.
“Plaintiff Hill is the lawful owner of a duplex (multi-family home) on property located at 8882-8884 Frankstown Road, Allegheny County, Pittsburgh, Pennsylvania 15235. Plaintiff Ricketts is a tenant who resides in the subject property,” the suit said. ....

Civil Rights Bill Sparks Fear Of Financial Calamity From Local Governments Across New Mexico

A civil rights bill that has sparked fears of financial calamity from local governments across New Mexico and ensnared the top-ranking Democrat in the state House of Representatives in an ethics complaint narrowly cleared the Senate Judiciary Committee on a 5-4 vote late Wednesday.
The committee chairman and Senate sponsor of House Bill 4, Sen. Joe Cervantes, broke a tie vote after a nearly 2 1/2-hour discussion and debate on the contentious measure.
“Do I see a 4-4 vote?” the Las Cruces Democrat asked the committee secretary just before 9 p.m. “I vote yes.” ....

Pittsburgh does not have to pay judgment for off-duty officer in assault, court rules

A Pennsylvania appellate court said that the city of Pittsburgh does not have to pay a $75,000 federal jury award to a man who had his nose broken by an off-duty Pittsburgh police officer more than eight years ago.
Shane McGuire, who at the time was 16, had been smashing pumpkins and ringing doorbells with his friends in Sgt. Colby Neidig’s New Homestead neighborhood in 2012, when the officer chased him down, subdued him, and ultimately broke his nose.
McGuire sued the officer in federal court, alleging civil rights claims, including excessive force, assault and battery. ....

Another busy week in store for the session, and today also marks the second to last Monday of the 2021 Legislative Session. Lawmakers will definitely have their hands full in these last days, with plenty of high profile measures still to decide.
Today we talk the status of House Joint Resolution 1, which is an annual effort to allow the state to take more money from the permanent land grant fund and put that money (about $170 million a year) toward early childhood programs. This measure has often been a political hot potato, but it passed out of Senate Rules on a 7-4 vote. Next, it will move to Senate Finance.  ....
