Robbins: Schenck v United States and the limits of free speech


This is the 14th part of an ongoing series on seminal cases in American law.
Now and again, over the last year or so, I have been devoting this column toward seminal cases, those Big Bang cases that helped coalesce the universe of American Law. Among the pantheon, with a seat pulled up to the table, is the case of Charles Schenck and Elizabeth Baer and their battle with the government.
The question, stated simply, is: How far does the First Amendment right to free speech go?
Charles Schenck and Elizabeth Baer were socialists. Notwithstanding the recent hue and cry coming from the political far right, socialists have been among us since the time of Vladimir Lenin’s Bolsheviks’ nearly bloodless coup d’état against the Russian Duma in October 1917. And further notwithstanding the right’s recent painting anyone who is slightly left of center as a socialist, Schenck and Baer were avowed and true believers. ....

Twitter's Trump Ban Sets Dangerous Precedent for Free Speech, Legal Scholar Warns


A law school dean says giving social media firms the power to permanently ban politicians could have serious ramifications for the future of free speech on the internet.
UC Berkeley Law School Dean Erwin Chemerinsky discussed social media and First Amendment implications in an online panel discussion Thursday.
SAN FRANCISCO (CN) Pondering the free speech implications of Twitter’s lifetime ban on President Donald Trump after a violent attack on the U.S. Capitol, a constitutional law scholar warned Thursday that a private company’s silencing of a sitting president sets a dangerous precedent.
“I worry that if we encourage Twitter to censor Donald Trump today, tomorrow it might be my speech or your speech that gets censored,” University of California, Berkeley Law School dean Erwin Chemerinsky said. ....

Legal Standard for Free Speech & When It Turns to Sedition

Roy Gutterman spends his days thinking about the First Amendment and freedom of speech. He should. He gets paid for it as the director of the Newhouse School s Tully Center for Free Speech at Syracuse University.  
When asked about Wednesday’s mass insurrection at the U.S. Capitol, he said that, to his mind, it’s clear there were people who crossed the line from political protest into violence. However, he said, that “line” continues to evolve.
According to Gutterman, the current legal standard was first enshrined in a 1919 Supreme Court decision called Schenck v. U.S., which dealt with the distribution of 15K leaflets protesting the country’s involvement in WWI. ....
