A new set of tax law amendments, signed by President Cyril Ramaphosa, and promulgated on 20 January 2021 has granted Sars all the legal fire power it needs to impose criminal sanctions on taxpayers who neglect their tax affairs.

Prior to the promulgation of the Tax Administration Laws Amendment Act, 2020 (Amendment Act) a mistake made by a taxpayer was only a crime when it was done “wilfully and without just cause.” In other words, the law required an element of intent; where negligence or ignorance caused your administrative non-compliance, you would have gotten off with a slap on the wrist. ....

Johannesburg - The Economic Freedom Fighters successfully appealed the North Gauteng High Court’s order to pay R500 000 in damages to Trevor Manuel after two judges of the Supreme Court of Appeals (SCA) ruled that the award of damages had been unjustifiably high.
The ruling was handed down on Thursday by SCA judges Mahomed Navsa and Malcolm Willis, who said that the order by the high court for the EFF to pay half a million rand to the former finance minister had appeared extraordinarily high and not in line with the recent general trend. ....

More than once, Public Protector Busisiwe Mkhwebane has been accused of lying to the courts. The issue raised its head again this week in a Constitutional Court ruling which in other respects was favourable to Mkhwebane.
The question at the heart of the latest Constitutional Court judgment was whether the South African Revenue Services (Sars) could withhold former president Jacob Zuma’s tax information on the grounds that taxpayers’ information is protected under the Tax Administration Act, or whether the Public Protector had the right to access that information by means of her subpoena powers, as she maintained.
A high court judgment on the matter previously found that the protection of taxpayer information was part of the constitutional right to privacy, and “serves the important purpose of encouraging voluntary disclosure by taxpayers”. It ordered Mkhwebane to pay 85% of Sars’ legal costs in her personal capacity. ....
