Less than a week ago, this writer lamented the state of liberal democracy in India, even asking if India actually was one. The lament was borne out of a concern over the expansive reach of the Indian state that undermined our fundamental rights, including the right to privacy, in multiple ways. The Special Marriage Act of 1954 was one such example, which mandates that two consenting adults ought to notify a government officer 30 days before their agreed upon date of marriage, after which their details would be made part of a public notice, and accessible to anyone, including those who wished to raise objections. The marriage officer would then inquire into any objection, and be empowered to prevent the marriage from going ahead until he or she was satisfied. ....
