Texas House committee hears tort reform measures, including bill to stop abuse of public nuisance

AUSTIN – A number of tort reform measures were heard yesterday by Texas House members, including bills on public nuisance, loser pays and paid or incurred.
The Judiciary & Civil Jurisprudence Committee spent the better part of the day listening to testimony. About forty minutes into the session, House Bill 2144 was discussed.
Authored by Rep. Cody Harris, HB 2144 seeks to ensure that the tort of public nuisance is clearly defined and consistent with its traditional purpose.
“The Texas economic miracle is built on low taxes … and legal reform – the last thing we need to do is return to the day when Texas was the world’s courtroom where money-hungry plaintiff’s attorneys filed one frivolous lawsuit after another,” Harris told committee members. “House Bill 2144 will keep Texas a national leader in legal reform and will stop activist attorneys from abusing public nuisance lawsuits. ....

City officials, along with representatives from Austin’s music venues, came out in strong opposition this afternoon to HB 3813, a bill that would strip large cities of their power to regulate amplified sound coming from bars.
At an afternoon press conference, held at 3ten ACL Live, Mayor Steve Adler portrayed Austin’s sound policies as the result of extended civic relations.
“This community, consisting of residents, music industry representatives, and clubs, came together and resolved years-long disputes about how everybody can exist in peace and in a way that maximizes quality of life for the entire community,” he said. “That’s what good neighbors do. In this instance, the outside interference from the legislature would be misguided, misdirected, not welcome, and not appropriate.” ....

Sunflower plans virtual Gala; items needed for live and silent auctions
Cody Harris arranges a few items that have been donated to the Sunflower Diversified Services Charity Gala silent and live auctions that will be available online April 24. Harris is director of planned giving and community support at the non-profit agency.
Even though the traditional Sunflower Diversified Services Charity Gala had to be canceled this year because of the pandemic, a virtual substitute has been scheduled.
The all-day event is set for Saturday, April 24, featuring silent and live auctions. The silent version will run from 8 a.m. to 6 p.m.; the live auction is scheduled for 6:30 to 7:30 p.m. ....

Texan Adoptees Are Fighting for the Right to Access Their Own Birth Certificates

Shawna Hodgson was adopted as an infant in the seventies and, she says, “raised in a great family” in Houston. But despite her happy childhood, she always had an underlying need to know more about her birth family. When Hodgson became an adult, she decided to request a copy of her original birth certificate
, something she had always assumed she was entitled to receive, from the Texas Department of State Health Services’ vital statistics office. Her request was immediately denied. 
“I didn’t know that my original birth certificate was sealed. I just kind of assumed they would hand that information over to me when I was [of age],” says Hodgson. “So imagine my surprise when I marched in there like, ‘I’m ready for my file,’ and they were like, ‘No, no, no. You don’t have the right to that.’”  ....

Proposed Texas bill would let Tesla sell directly to consumers


Automobile manufacturers such as Ford, General Motors, Honda and others are prohibited from selling directly to consumers in Texas, but Tesla soon might get a green light to do so.
A proposed state law would carve out special treatment for certain makers of electric vehicles, allowing them to skirt strict Texas regulations requiring all auto sales to be funneled through third-party franchised dealerships.
Tesla which is building a $1 billion-plus factory in southeastern Travis County that s expected to open late this year is the biggest-name potential beneficiary of the special treatment, although it also would be a boon to growing numbers of lesser-known electric-vehicle makers that are following similar business models. ....
