Colorado Supreme Court mandates diversity, equity, inclusivity training


Over objections that the programming constitutes indoctrination, the Colorado Supreme Court on Thursday approved mandatory equity, diversity and inclusivity training for attorneys as a means of retaining diverse attorneys and recognizing systemic bias.
Colorado joins more than half a dozen other states that have a standalone requirement for EDI, as the training is known. It will become part of the 45 credit hours of continuing legal education (CLE) attorneys need to complete in a three-year period.

(CN) The Colorado Supreme Court on Monday shot down a tactic employed by Colorado Democrats in 2019 to circumvent the reading of a 2,000-page bill out loud.
As they held majorities in both the state Senate and House during the 2019 Colorado legislative session, Democrats were in the process of powering through a bill that would massively change the way the state regulates oil and gas development.
In efforts to pump the brakes, several Republicans requested the reading of a 2,000-page bill, “Title 12 Recodification and Reorganization.”
The state constitution requires “every bill shall be read by title when introduced, and at length on two different days in each house; provided, however, any reading at length may be dispensed with upon unanimous consent of the members present.” ....

DENVER – The Colorado Supreme Court on Friday announced the team of people who will be tasked with selecting a separate team of independent investigators to look into allegations of sexual misconduct and a no-bid contract in the state’s judicial branch.
The court announced on Monday that members of the governor’s office, attorney general’s office and state General Assembly would pick the independent investigators.

Colorado court OKs rules on sealing criminal court records

DENVER (AP) The Colorado Supreme Court on Thursday voted to approve rules for how criminal trial judges can restrict public access to court records, a direct response to Denver Post stories that exposed how thousands of cases have been kept from public view with little to no oversight for how that was done.
The rules, proposed by a statewide committee of attorneys and judges who made recommendations after months of meeting behind closed doors, are to take effect sometime in 2021, according to Chief Justice Nathan Coats who disclosed the approval at a meeting of the legislature’s Joint Budget Committee. ....

Justices consider 'disruptive effect' of potential self defense requirement | Colorado Politics


Although Colorado law provides multiple ways of disproving a criminal defendant acted in self-defense, the Colorado Supreme Court on Wednesday considered whether jurors must agree unanimously on which single condition nullifies a self-defense argument.
In doing so, one of the justices worried that a newfound unanimity requirement could open up past criminal convictions to reversal.
“Boy, we have a lot of cases out there that you could have criminal defendants saying, ‘Well, we don’t have a unanimity finding. We need to go back and reverse my conviction,’” said Justice Monica M. Márquez during oral argument. “I m just concerned about the disruptive effect of such a rule.” ....
