With 44 of the 50 Senate Republicans declaring that impeaching a president who is no longer in office is unconstitutional, the House of Representatives’ resolution to impeach Donald Trump for inciting an insurrection on Jan. 6 will almost certainly fall far short of the 67 votes required to convict him.
Nonetheless, Americans should remember that although many Trump loyalists in the Senate refuse to hold the former president accountable for the assault on the Capitol, they do hold him responsible.
Perhaps the tally would be different if the ballot were secret.

Cassidy calls Trump legal team 'disorganized,' 'random' after surprise vote to proceed with trial


I said I d be an impartial juror. Anyone listening to those arguments the House managers were focused. They were organized. They relied upon both precedent, the constitution and legal scholars. They made a compelling reason. President Trump s team were disorganized, he said.
Cassidy on Tuesday voted along with all Democrats and five other Republicans to say that it was constitutional to hold the trial, the first for a president already out of office.

“If you feel that you have no authority, then you can’t go on and say ‘well we have no authority but I guess I’ll go ahead and convict anyway,’ ” Hawley said. “I’d be surprised if many or any of those people change their minds on the underlying question of whether or not to oppose a penalty or not.”
