Kentucky's GOP legislature grabs the wheel from Democratic governor


When Kentuckians elected Andy Beshear in 2019, they created a recipe for partisan conflict between a legislature with a recent, ultra-Republican majority and a governor from a greatly diminished Democratic Party. In the recently completed legislative session, the governorship itself was diminished.
Legislators took some powers from the governor, gave a few to Republicans who hold other statewide offices, and put on the 2022 ballot a constitutional amendment to let the legislature call itself into session for 12 extra days a year and extend its 30- and 60-day sessions past the current deadlines of March 30 and April 15.
Reacting to Beshear’s anti-pandemic orders, legislators also tried to rein in the governor’s emergency powers. Franklin Circuit Court blocked that legislation, much as the state Supreme Court had rejected legal challenges to the orders. Rumors have been swirling on social media that Kentucky s mask mandate is no longer valid due to a resolution.So, we looked into it and found the facts. The statewide mask mandate to slow the spread of COVID-19 is indeed still in effect. The resolution some are citing is House Joint Resolution 77, which was designed to end the mask mandate while affirming some other emergency executive orders but Franklin Circuit Court Judge Phillip Shepherd issued a temporary injunction blocking it. In his ruling, Shepherd wrote, Until this issue has been resolved, it would create a great public harm and would undermine effective public health requirements to allow the temporary suspension or termination of the Governor’s public health orders.   Kentucky lawmakers reshaped state government during this year’s legislative session, limiting Gov. Andy Beshear’s powers while shifting authority to the legislature and state offices currently controlled by Republicans.
Republicans began the session by curbing Beshear’s powers during the pandemic laws the governor is challenging in court. This effort continued throughout the session, with new measures chipping away at the governor’s authority outside the state of emergency.
