Eleven homeless people in Cape Town have gone to court to have several City of Cape Town municipal by-laws declared unconstitutional and discriminatory.
On 31 March, applications were filed at the Western Cape high court and at the Equality Court to challenge the City by-laws on Streets, Public Places and the Prevention of Noise Nuisances (2007) and Integrated Waste Management (2009).
The applicants are represented by the Ndifuna Ukwazi Law Centre.
In a statement, Ndifuna Ukwazi said that the by-laws unfairly discriminate against homeless people and they infringe on their fundamental human rights, including the rights to equality, human dignity, freedom and security of the person, privacy, freedom of movement and residence, and property. ....

Cape Town - Despite going virtual, the Cape Town Pride Parade is all about visibility this year, said festival director Mathew van As.
The annual festive parade is set to follow other large-scale events by moving on to virtual platforms and will host daily events this month, culminating in its main event – a virtual pride parade and Mardi Gras. The theme this year is #YOUMATTER.
Thousands of members of the LGBTQIA+ community and allies have been gathering for the parade, donning rainbow-themed outfits, flags, and signs for the past 19 years. ....

Cape Town - Greenmarket Square refugees spokesperson Papy Sukami is fighting deportation by the Department of Home Affairs after his asylum-seeking papers were rejected by the Refugee Appeals Authority of South Africa (Raasa), which claims he is a fugitive.
According to a statement from Raasa dated Friday, February 26: “A final rejection notice by Raasa is ready and the department is in the process of serving the outcome. However, Sukami remains a fugitive as he is currently in hiding. The security cluster departments are assisting in tracing Sukami.”
Raasa is an independent body that adjudicates appeals by refugees who have been denied asylum by the department. ....

Cape Town - Parliament’s Home Affairs portfolio committee has set March 15 as the deadline for the UN High Commissioner for Refugees (UNHCR), the City and the department of Home Affairs together to come up with a plan for the former Greenmarket Square refugees.
During a meeting on Friday, the committee’s acting chairperson Mosa Chabane said: “The committee is concerned that since November 30, 2020 no meetings took place as a result of the Level 3 Covid-19 regulations. This is unsatisfactory and has a delaying impact on the finalisation of the exit plan. ....

In October, the Department of Home Affairs told the committee it was formulating an exit strategy, but the state of disaster has had a significant impact on its plan.
Several times the committee has requested that all spheres of government come up with a solution.
The Department of Home Affairs says it is in discussion with neighbouring countries over repatriation efforts to handle the refugee crisis arising from those people who occupied Greenmarket Square and the Central Methodist church. ....
