ISLAMABAD: A division bench of the Islamabad High Court (IHC) on Wednesday dismissed the petitions seeking to stop the auction of a property owned by former prime minister Nawaz Sharif, declaring them as non-maintainable.
The bench said the IHC could not hear the case under section 199 when the petitioners had other forums for relief, adding the litigants should have filed the application in the trial court for stopping the auction.
The bench comprising Justice Aamir Farooq and Justice Tariq Mehmood Jahangiri announced the decision which was earlier reserved after hearing arguments from the petitioners’ counsel against the property auction in Toshakhana reference.

ISLAMABAD: The Islamabad High Court Wednesday rejected the petitions filed by former premier Nawaz Sharif and others, seeking court directives for stopping the auction of their properties deeming them inadmissible.
Divisional bench of the Islamabad High Court comprising Justice Tariq Mehmood Jahangiri and Justice Amir Farooq, in a short decision said the applicants have the alternate platform and they can go to the trial court to stop the auction of the properties of the former prime minister.
The court said due to availability of an alternate forum the high court cannot hear the petitions according to Article 109 of the Constitution. Earlier, Qazi Misbah, counsel for the former prime minister, argued before the court that the purpose of auctioning proclaimed offender’s property was to force him to surrender.

ISLAMABAD, (UrduPoint / Pakistan Point News - 19th May, 2021 ) :A division bench of Islamabad High Court (IHC) on Wednesday reserved its judgment on maintainability of petitions challenging auction of former prime ministerNawaz Sharif s property in toshakhana corruption reference.
A division bench comprising Justice Aamir Farooq and Justice Tariq Mehmood Jahangiri took up the cases against the confiscation and auction of Nawaz Sharif s property under the decision of an accountability court. The three separate petitions were filed by Mian Iqbal Barkat, Aslam Aziz and Muhammad Ashraf Malik through their counsel Qazi Misbah to IHC.
