Judge grants new trial for man convicted of 2000 Lancaster home invasion

Two decades after Ralph Blaine Smith was sentenced to 67 years in prison for a Lancaster home-invasion, a Fairfield County judge has granted him a new trial, ruling that prosecutors withheld evidence that suggested the crime never occurred. In a ruling filed Wednesday, Common Pleas Judge Richard E. Berens found that the withheld evidence was sufficiently material to establish a reasonable probability of a different result, and as such the nondisclosure has undermined the confidence in the verdict and violated Smith s right to due process. The motion for a new trial, filed by Columbus defense attorney Joe Landusky, focused on evidence suggesting that the crime may have been staged.

McNally gets 18 years in prison for involvement in teen s death

LANCASTER - For Laura Tabor and her family, this Mother s Day was a melancholy affair: instead of getting flowers from her son, Haylen, she was putting them on his grave. Laura got some modicum of justice Friday as one of the four people charged in Haylen s death in January received a prison sentence. Brandon McNally, 21, of Lancaster, was sentenced to a minimum of 18 years and a maximum of 20-and-a-half years in prison after he pleaded guilty to one count of involuntary manslaughter, a first-degree felony; a specification to count one alleging McNally had a firearm on him or near him during the committing of the first count; and one count of aggravated robbery, a first-degree felony.
