It is widely recognised that parties who are dissatisfied with arbitration awards will generally have very limited rights to challenge those awards.  Indeed, the finality of arbitration awards is often one of the attractions of arbitration as a dispute resolution mechanism.
However, another (albeit limited) option that might be available to a party who considers that an award contains errors is to ask the tribunal that issued the award to correct or interpret the award, a procedure that is permitted under the rules of most arbitral institutions and the arbitration laws in many jurisdictions.   ....

The Fundamental Problem
International arbitration is facing continued (if not increased) problems stemming from multitier arbitration clauses. What should happen when one party has not complied with a pre-arbitral step but nonetheless commenced arbitral proceedings? Typically, the parties have a satellite dispute: on one side, whether the commencement of the arbitration is void thus depriving the arbitral tribunal of all jurisdiction due to the non-compliance and on the other side, whether such non-compliance is an issue of admissibility that falls within the arbitral tribunal’s remit to address by way of procedural modification (for example, by ordering a stay of proceedings pending completion of a negotiation period). ....

The English High Court (Sir Michael Burton GBE) has handed down a significant judgment dismissing a challenge to a Tribunal’s jurisdiction under section 67 of the Arbitration Act 1996 -
Republic of Sierra Leone v SL Mining [2021] EWHC 286 (Comm). King & Spalding represented SL Mining before the High Court and continues to represent it in the ongoing underlying ICC Arbitration, and in an ICSID Arbitration. Thomas K. Sprange QC and Kabir Bhalla appeared with Ali Malek QC in the High Court, instructed by John Savage QC.
The decision is the first detailed consideration in English law of the distinction between jurisdiction and admissibility in a jurisdiction challenge under section 67 of the Arbitration Act 1996. Doha, Qatar - (February 23, 2021) - A group of researchers at Qatar Foundation have reported the first and largest genetic association study in the Middle East, that has been published online in
Nature Communications - a leading a peer-reviewed, open access, scientific journal published by Nature Research.
The study titled Whole genome sequencing in the Middle Eastern Qatari population identifies genetic associations with 45 clinically relevant traits highlights a vital piece of information wherein now there is a better understanding of the genetic risk factors that are specific to the Arab population, including those that are shared with other ethnicities. ....
