The Gauhati HC said the change can be made owing to the exceptional circumstances now
GUWAHATI: The Gauhati High Court, while modifying its last year’s order in a suo moto writ petition concerning the Covid situation in the state, has directed the authorities to release foreigner detenues who have completed two years of detention on personal bond of Rs 5,000 and one surety, instead of two, owing to the exceptional circumstances of second Covid-19 wave.
“No separate order needs to be passed in each case and the concerned authorities are hereby directed, wherever such detenues are detained, to release them forthwith as and when they complete their two years of detention with the following modification that under these exceptional circumstances of the second wave of Covid-19 pandemic, they may be released on their personal bond of Rs 5 ,000 and one surety instead of two sureties,” the order stated. ....

Gauhati HC grants bail to writer arrested over FB post on jawans | Guwahati News

GUWAHATI: The Gauhati High Court, while observing that Assamese writer Sikha Sarma had expressed her personal views on the use of the term ‘Swahid/martyr’, granted bail to the 48-year-old writer, who was arrested here on April 6 on charges of sedition and other offences for an alleged Facebook post on security forces after 22 personnel were killed in a Maoist attack in Chhattisgarh.
According to the FIR, Sarma, known to be vocal on social media, in an FB post on April 5 maligned and disregarded the sacrifice of martyrs by urging the ‘media’ not to generate public sentiments in their favour and not to term them as ‘swahids’ as they are drawing salary for the services they are providing to the nation . ....

The Gauhati High Court has dismissed the State appeal filed against the order of a Special NIA Court that granted bail to activist Akhil Gogoi last year, in connection with a case of rioting.
While doing so, a Division Bench comprising of
Justices Suman Shyam and
Mir Alfaz Ali made it clear that mere that to attract the offences punishable under the Unlawful Assemblies (Prevention) Act, 1967 the act complained of must be a terrorist act committed with the intention to threaten the integrity, sovereignty of India, etc.
It further held that merely causing civil disturbances, without the element of intention to cause terrorist act would not fall within the ambit of unlawful activity under section 2(1)(o) of the UAPA Act. ....
