Forensic experts testified that Benjamin Dowling s death had been linked to the shaken baby syndrome he experienced under Terry McKirchy, the babysitter who cared for him when he was 5-months-old. In 1984, McKirchy was hired to look after Dowling. The baby s mother took him to a doctor when she noticed that he had breathing difficulties and his body was limp. The doctor told the family that the baby had severed blood vessels in his brain due to being shaken with such a force.

Woman faces murder charge after victim of decades-old ‘shaken baby’ case dies at 35 FORT LAUDERDALE, Fla. – Terry McKirchy is facing a first-degree murder charge for a crime that prosecutors said she committed nearly four decades ago in Broward County. She thought the case was behind her, but a medical examiner’s office report shows differently, prosecutors said. Benjamin Keith Dowling died Sept. 16, 2019 in Manatee County. He was 35 years old. After performing an autopsy, forensic experts with the medical examiner’s office ruled Sept. 27, 2019 that Dowling’s cause of death was “sequelae of abusive head trauma.” Prosecutors said the head injury happened in 1984.

Ex-babysitter charged with murder 37 years after shaking infant, prosecutors say

A former babysitter who served a few months in jail for shaking a 5-month-old boy so forcefully 37 years ago that he suffered permanent brain damage now faces a possible life sentence after his death from those injuries in 2019, at age 35, officials said. Terry McKirchy, 59, who now lives in Texas, was arrested again on July 2 after a grand jury in Broward County, Florida, indicted her on a first-degree murder charge in the death of Benjamin Dowling, prosecutors said this week. She was taking care of him at her home in Hollywood, Florida, on July 3, 1984, when he had difficulty breathing, the authorities said. His mother told investigators that she immediately took him to a hospital, where doctors found that he had been shaken with such force that it had severed the blood vessels to his brain.
