SCOTUS case on disclosure of nonprofit donor names raises First Amendment questions
Image from Shutterstock.com. More than 60 years ago, the U.S. Supreme Court ruled that the state of Alabama could not require the NAACP to disclose its membership list. In NAACP v. Alabama ex rel. Patterson, the court unanimously held that the civil rights organization had shown that disclosure of its members in the state would expose them to retaliation in the Jim Crow South. “This court has recognized the vital relationship between freedom to associate and privacy in one’s associations,” Justice John Marshall Harlan II wrote for the court. “Inviolability of privacy in group association may in many circumstances be indispensable to preservation of freedom of association, particularly where a group espouses dissident beliefs.” ....
Hundreds Of NPOs Join SCOTUS Donor Battle March 4, 2021 Some 275 nonprofits signed on to 35 amicus briefs in support of two organizations taking the California Attorney General’s Office to the Supreme Court of the United States to fight donor disclosure requirements. The briefs were filed Monday in Thomas More Law Center v. Becerra (Docket No. 19-255). In January, the U.S. Supreme Court granted certiorari to hear the case. The nation’s highest court consolidated two cases by the Thomas More Law Center and the Americans For Prosperity Foundation and could hear oral arguments as early as next month. The NonProfit Alliance (TNPA), the Association of Fundraising Professionals (AFP) and PETA co-sponsored a brief with 123 organizations signing in support of the Thomas More Law Center and Americans For Prosperity Foundation.
