Law Review: Aggregate operation expansion EIR challenged

When a large project is proposed, such as Syar Industries expansion of its aggregate operations in Napa County, the California Environmental Quality Act specifies what must be included in the environmental impact report (EIR) analyzing the project and its impacts. It is not uncommon for a large project to be challenged in court claiming the project EIR is legally inadequate. See Stop Syar Expansion v. County of Napa, our case for today’s column.
SEVEN YEARS OF ENVIRONMENTAL REVIEW
A group known as Stop Syar Expansion had long opposed the expansion of Syar Industries aggregate operations in Napa County. After more than seven years of environmental review and numerous hearings, the county planning commission certified the final EIR and approved a much smaller project than originally sought. Del Mar to prepare 'focused' environmental study for Heights rebuild

The Del Mar Heights School rebuild is on hold as the Del Mar Union School District completes additional environmental reviews, stemming from a court decision in the lawsuit against the district by Save the Field.
The district had planned to break ground on the project last summer and for students to be in their new school in August 2021, however, Heights students will continue to attend school off-site in the 2021-22 school year at Ocean Air School and Del Mar Hills Academy.
The project has been slowed by the requirement for a coastal development permit from the City of San Diego and the lawsuit, which alleges the district failed to comply with California Environmental Quality Act (CEQA) with its “insufficient” Mitigated Negative Declaration (MND) that concluded that the rebuild will result in no significant impacts on the environment. At the Feb. 24 meeting, the board vacated its approval of the MND to begin work on a “focused” environmental impact repor ....

Sunny Ghai has always wanted to move his fast-food restaurants to Ripon.

At its January 20, 2021 Board meeting, the State Water Resources Control Board (“SWRCB” or “Board”) adopted its final General Waste Discharge Requirements (“WDRs”) for Winery Process Water (“Winery Order”) and associated Resolution for the California Environmental Quality Act (“CEQA”) Mitigated Negative Declaration.
As a brief background, on July 3, 2020 the SWRCB released a draft Winery Order to the public for comment (see: July 15, 2020 blogpost on proposed General Order and July 20, 2020 blogpost on noticed stakeholder meetings). The July 3, 2020 draft incorporated feedback from stakeholders regarding administrative draft documents circulated in 2019.
