Insults To Religion Without Deliberate Intention Not Offence Under Section 295A IPC: Tripura HC

New Delhi: The Tripura high court (HC) has held that insults to religion made without any deliberate or malicious intention to outrage the religious feelings of a class would not amount to an offence under Section 295A of IPC,
The single bench of Chief Justice Akil Kureshi noted: “Section 295A does not penalise any and every act of insult or an attempt to insult the religion or the religious beliefs but it penalises only those acts of insults or attempts which have been perpetrated with the deliberate and malicious intention of outraging the religious feelings of a particular class.” ....

The Indore bench of the Madhya Pradesh High Court on Friday granted interim bail to Nalin Yadav and Sadakat Khan, who were arrested with comedian Munawar Faruqui, in relation to a case registered against them by the Indore Police for allegedly hurting religious sentiments,
Bar and Bench reported.
Justice Rohit Arya passed the order in light of the Supreme Court judgement on February 5, granting bail to Faruqui, according to
Bar and Bench. Then on February 12, bail was granted to two other co-accused in the case, Prakhar Vyas and Edwin Anthony. After Friday’s verdict, all accused who were put in custody on January 1, have been allowed bail. ....
