Alleged forgery/impersonation: Court admits WAEC tendered copy against lawmaker

A Criminal Court 1 of the Edo High Court, on Wednesday, admitted in evidence a certified copy of the West Africa Examination Council (WAEC) certificate against lawmaker-elect of the Edo State House of Assembly (EDHA), Mr Ugiagbe Onaiwu.
Onaiwu is one of the 14 lawmakers elect, who refused to present themselves for inauguration in June 2019, when Governor Godwin Obaseki issued the proclamation instrument.
The 14, whose seats had since been declared vacant by a Port Harcourt Federal High Court, had rather preferred to pitch tent with the erstwhile National Chairman of the APC, Adams Oshiomhole, as the former labour leader fought for the soul of the party with his estranged political godson, Obaseki, in the build-up to the 2020 governorship election, which the governor won on the platform of the Peoples Democratic Party (PDP). ....

Reprieve came the way of members of the Edo State Law Review Commission, which was dissolved 13 years ago in 2008, as the Benin Division of the Court of Appeal nullified the dissolution and ordered that they be reinstated to complete their tenure.
In addition, the appellate court made an express order that the truncated tenure should now run from 25th March 2021, the day the judgment was given, to 25th August 2025.
The court, in a unanimous decision by the three-man panel delivered by Justice Biobele Abraham Georgewill, affirmed that the commission was a tenured entity, adding that the administration of Comrade Adams Oshiomhole dissolved the commission did not pass through the laid down procedure. ....

Court nullifies suspension of Edo LG Chairman, orders his immediate reinstatement

An Edo High Court sitting in Benin, on Friday declared as illegal, the removal of Mr Aremiyan Momoh, as Chairman of Etsako East Local Government Area of Edo State.
The court presided over by Justice D. I. Okungbowa, in suit no: B/205/2019, said Momoh’s removal from office as chairman and his subsequent replacement with his erstwhile vice-chairman, Mrs Benedicta Ebuehi is illegal.
Momoh, it would be recalled, was suspended from office by Governor Godwin Obaseki over alleged corrupt practices in September 2019 and was replaced with Ebuehi, who just last week, marked her one year in office.
Justice Okungbowa, in his judgement, declared the action of the governor as null and void and directed Momoh be reinstated immediately. ....

An Edo High Court sitting in Benin has declared as illegal the suspension of Mr Aremiyan Momoh as the Chairman of the Etsako East Local Government Area of the state.
The court, presided over by Justice D. I. Okungbowa, on Friday, delivered the judgement in the case with suit no: B/205/2019.
Momoh had been suspended from office by Governor Godwin Obaseki over alleged corrupt practices in September 2019.
But while delivering the judgment, Okungbowa declared the action of the governor as null and void and directed that Momoh be reinstated immediately.
The judge held that the state government failed to comply with the provisions of Sections 20 and 21 of the Edo State Local Government Law, 2000 (as amended) in failing to consult with the Edo State House of Assembly as provided by law before suspending Momoh. ....
