: On May [24]th at about 3:22 PM, A Ukiah PD officer noticed a vehicle stopped, blocking the driveway of the E. Perkins St. Chevron. The officer initiated a vehicle check and contacted a male occupant who was identified as Aldar Fragoso. Fragoso was uncooperative and exhibited bizarre behavior. Fragoso had red stains on much of his clothing as well as congealed blood in the center console of the vehicle. Fragoso was not cooperative and concerns grew for the subject’s safety as a bloody pair of pruning sheers was located and removed from the vehicle. Mendocino County Sheriff’s Department deputies, Paramedics, Firefighters, and Mental Health workers all responded to the scene, but could not gain compliance or cooperation from the subject. MCSO deputies had contacted Fragoso earlier in the day and informed UPD officers that he had a dog with him. When asked about the dog, Fragoso said he did not have a dog. The sheers were presumptively tested ....
Magdaleno supporters gather on the steps of the Ukiah Civic Center April 7, 2021 The family of Gerardo Magdaleno, the mentally ill man who was beaten by Ukiah police last week, is preparing to sue the city. Their lawyer, Isaak Schwaiger, is a civil rights attorney who specializes in police brutality cases. The case has not been filed yet, but Schwaiger says “It is primarily an excessive force lawsuit.but it also has a component that’s derived from the Americans with Disabilities Act.” Another claim will be inadequate training at the UPD for dealing with people having a mental health crisis. There will be a money damages claim, but Schwaiger also plans to ask for reform at the department. ....
UKIAH, California (KGO) It is the kind of video one might expect in a big city, not a relatively small town. That is why Ukiah residents are so upset about an incident on April 1 and why the city announced late Monday why it is launching an independent investigation. Videos from two angles show officers dealing with 25-year-old Gerardo Magdelano, a homeless man who had been walking naked down South State Street. “The gentleman was not aggressive to officers. He did not advance on the officer,” said Frank Pacino, who shot one of those videos. Family members describe Magdelano as being homeless and bipolar. They say that when a local hospital refused to treat him in a crisis, he self-medicated on LSD, got hot, took off his clothes, and went for the walk, causing no problems. ....
April 5, 2021 from Video from Facebook A group of Ukiah Police Officers are being investigated by their department for using excessive force against a mentally ill naked man. The incident occurred last Thursday when officers responded to a call about a naked man running in the roadway. Videos taken by bystanders show that the officers used pepper spray, tasers, and kicks and punches to subdue 25-year-old Gerardo Magdaleno who was taken into custody. He was treated for facial fractures and concussions at Adventist Health Ukiah Valley Hospital. Magdaleno’s family says that he has schizophrenia and had run out of medication and that he had taken LSD that morning. As part of a statement from Ukiah Police, the incident “will be evaluated and investigated per UPD Policy.” ....
