The state’s recently enacted Marijuana Regulation and Taxation Act includes a provision preventing employers from disciplining or discriminating against their workers for using the drug on their personal time “off of the employer’s premises and without use of the employer’s equipment or property.” But the new labor rights have limits.  (TU)
The state’s COVID-19 test positivity rate Saturday was below 1.5 percent for the first time since late October, a continuation of a declining trend that signals a return to pre-COVID normalcy could be on the horizon. Not since the stretch late last summer when New York saw rates below 1 percent has there been a such consistent lower positivity rate. The seven-day positivity rate has been decreasing consistently since early April, and it has decreased each day individually since April 26. (TU) ....

An Oneida County woman has tried to improperly influence a judge presiding over the disputed 22nd Congressional District election by sending him a series of “inappropriate” text messages, according to a public filing by the judge’s law clerk. ....

The 700,000 people who live in New York’s 22nd Congressional District should prepare to be without a representative in Washington for the foreseeable future as an epic battle unfolds for the undecided House election.
The post-election dispute between Anthony Brindisi and Claudia Tenney is likely to go on for months, history suggests, involving legal appeals in multiple courts and high-powered lawyers arguing over the fate of more than 2,000 disputed ballots. ....

Brindisi Tenney NY22: 2,400 voter registration forms not processed


More than 2,400 electronic voter registration applications, received before the state’s Oct. 9 deadline, were not processed in time for the election in Oneida County, according to testimony from an elections official in Oswego County Supreme Court on Friday. 
The issue of unregistered voters was first discussed at length during Thursday’s proceedings. At least 63 voters in Oneida County who completed registration forms through the state Department of Motor Vehicle Motor Voter online form were included in contested ballots in the race for New York’s 22nd Congressional District. 
Republican Claudia Tenney leads Democrat Anthony Brindisi in preliminary results by 29 votes. The congressional district is the only contested House of Representatives race remaining in the country and awaits the results of a ruling from state Supreme Court Justice Scott DelConte.  ....
