(The Center Square) – A law that went into effect this week allows pre-judgment interest on financial claims in certain cases, but it exempts the government from having to pay pre-judgment interest.In May, Pritzker signed Senate Bill 72 that allows 6 percent interest on personal injury and wrongful death claims to accumulate before there’s a court judgment. It went into effect Thursday. Supporters say the measure deters companies from stalling on cases when they get sued.Illinois Manufacturers’ Association’s Mark Denzler said one element of the law signals to himthat it is bad policy by who is left out.“It’s always telling when the government passes a law that imposes, in this case, a new 6% penalty, and they exempt themselves from it,” Denzler told WMAY. “I don’t know if there’s a clearer way to say if it’s such a great policy why did the state exempt themselves from the same law?”Pritzker’s office
More than a dozen provisions in a criminal-justice equity bill spearheaded by Black lawmakers and signed into law by Gov. JB Pritzker including sections dealing with police misconduct records and officers’ use of force take effect Thursday.
Additional laws that take effect July 1 include one that deals with pretrial interest costs in wrongful-death lawsuits.
The criminal-justice legislation, passed in the lame-duck session this year and during the General Assembly’s spring session, was championed by the Illinois Legislative Black Caucus.
The caucus successfully pushed through wide-ranging legislation on criminal justice and economic, educational and health care disparities in response to the 2020 death of George Floyd at the hands of Minnesota police and other racial strife nationwide.
