Prayagraj: Directing police to protect an interfaith couple, the Allahabad high court said on Tuesday, June 8, that the woman having converted to Islam is not a relevant factor in ensuring that there is no interference in the liberty of the couple, unless there is any allegation by her regarding forcible conversion.

Gujarat HC orders immediate release of inter-faith couple

Gandhinagar: Taking up a Habeas Corpus plea, the Gujarat High Court has ordered the immediate release of an inter-faith married couple, arrested by Palanpur police in Banaskantha district on a complaint from the woman s family.
A 30-year-old Muslim man from Palanpur married a 29-year-old Hindu woman of the town in December last year.
On January 9, following the complaint by the woman s father that his daughter stole Rs 82,000 and fled with an already-married Muslim man, the Palanpur police had detained the couple, who were residing in Surat. A local court subsequently sent them to four day police custody, as sought by the police. ....

The requirement of publication of notice under Section 6 and inviting or entertaining objections under Section 7 can only be read as directory in nature, the court held.
In a significant judgment affecting inter-faith couples seeking to get married under the Special Marriage Act, 1954, the Allahabad High Court has ruled that it would be optional and not mandatory for them to publish a notice about their intended marriage.
The provision for mandatory publication of notice, derived through “simplistic reading” of the particular law, “would invade in the fundamental rights of liberty and privacy, including within its sphere freedom to choose for marriage without interference from state and non-state actors, of the persons concerned,” the court said in a judgment delivered on January 12. ....

A Muslim youth who flew down from Bengaluru to Lakhimpur Kheri to meet a Hindu girl whom he had befriended online, was surprised when he was beaten up and then taken to a police station and detained overnight on alleged grounds of love jihad.
According to a report in the Times of India, even though a local right-wing outfit insisted that the law enforcement officials should press anti-conversion charges against the 21-year-old youth, the police took him into preventive detention on Sunday evening and released him on a personal bail bond on Monday. ....
