The Fair Work Ombudsman has secured a court-ordered penalty against the former operator of a fast food outlet in Brisbane.
The Federal Circuit Court has imposed a $14,175 penalty against SMC Food Truck Pty Ltd, which formerly operated a business trading as ‘Salts Meats Cheese’ at the Garden Pantry precinct in West End.
The penalty was imposed in response to SMC Food Truck failing to comply with a Compliance Notice requiring it to calculate and back-pay entitlements owing to 24 former employees.
The Fair Work Ombudsman made attempts to secure voluntary compliance prior to commencing legal action, however the company back-paid the employees in full only after the FWO commenced the action. ....

The Fair Work Ombudsman has penalised the former operator of a Central Coast civil construction business.
A $33,300 penalty was imposed against MDP Labour Pty Ltd by the Federal Circuit Court, for the labour company failing to back-pay a former employee.
The company provided services including laying pipes and earthmoving, and worked with the National Broadband Network.
The former employee, then aged 20, worked for the business as a labourer since he was 16.
In addition to the penalty, the Court ordered MDP Labour to rectify underpayments in full, plus superannuation and interest.
Fair Work Ombudsman Sandra Parker says companies that fail to act on Compliance Notices can face maximum penalties, like the one in this case. ....

The Fair Work Ombudsman has commenced legal action in the Federal Circuit Court against the operator of a Newcastle cleaning business.
Facing court is Michael James Henshaw, a sole trader operating Spit and Polish Professional Cleaning.
The regulator began an investigation after receiving a request for assistance from a former part-time employee who worked for the Merewether-based business between January and October 2019.
A Fair Work Inspector issued a Compliance Notice to Mr Henshaw in January 2021 after forming a belief that the cleaner had not been fully paid wages and annual leave entitlements, including leave loading, she was owed under the Cleaning Services Award 2010 when her employment terminated. ....

The Fair Work Ombudsman has secured a court-ordered penalty against a dental practice in Campbelltown, Sydney.
The Federal Circuit Court has imposed a $6,000 penalty against Available Dental Care Pty Ltd and $1,400 against Doctor Seyed Shahabeddin Lajevardi, also known as Shaun Lajevardi, the company’s director.
The penalties were imposed in response to Dr Lajevardi breaching the Fair Work Act by failing to comply with a Compliance Notice requiring him to calculate and back-pay entitlements owing to three workers.
The affected workers were two dental assistants and a 19-year-old receptionist, all employed on a part-time basis. ....
