The Fair Work Ombudsman has commenced legal action in the Federal Circuit Court against the operators of a bakeware manufacturing and supply business located in Sydney.
Facing court are Mackies Asia Pacific Pty Limited, which trades as ‘Mackies’, and company director Dmitry Myndreskou.
The FWO commenced an investigation after receiving a request for assistance from a worker who was employed by Mackies Asia Pacific as a sales director for more than 20 years before his employment concluded last year.
A Fair Work Inspector issued a Compliance Notice to the company in February 2021 after forming a belief the worker was not paid his accrued but untaken annual leave entitlements in full at the conclusion of his employment. ....

Court ruling in truckie underpayment case shows need for industry reform: TWU

A Federal Court ruling on a $6000 rip off of a long-distance truck driver is the tip of the iceberg and shows need for urgent industry reform, say the TWU.
The Court fined Sapphire Freighters Pty Ltd $21,500 for failing to comply with an earlier Compliance Notice and ordered the payment of outstanding entitlements to the driver who drove between Melbourne and Brisbane.
Trucking is Australia’s deadliest industry, with underpayments, fatigue, speeding, and deaths and injuries from truck crashes linked to the low-cost contracts demanded by wealthy supermarkets and manufacturers at the top of the supply chain.

Former Gold Coast restaurant operator penalised
The Fair Work Ombudsman has secured a penalty in the Federal Circuit Court against the former operator of a Gold Coast restaurant.
The Federal Circuit Court has imposed a penalty of $3396.60 against Mr Seouk Woong Hong, who formerly operated a Korean restaurant trading as Sogongdong Tofu House at Southport.
The penalty was imposed in response to Mr Hong being involved in failing to comply with a Compliance Notice requiring the back-payment of entitlements to three former employees at the restaurant.
The Court made orders allowing the penalty to be paid to the three former employees to partially rectify the underpayments, which remain outstanding. ....

The Fair Work Ombudsman has commenced legal action in the Federal Circuit Court
against the operator of a plumbing business based at Jordan Springs, in western
Sydney.
Springs Plumbing and Air Conditioning’ and ‘Jordan Springs Plumbing and
