Planning commissioner recuses from Clear Space matter

Following a hearing with the state’s Public Integrity Commission, Rehoboth Beach Planning Commissioner Rachel Macha has recused herself from the Clear Space hearing set to resume Friday, Feb. 26.
Macha’s recusal comes after members of the public questioned her impartiality. She had independently contacted a sound engineer who submitted a report to the planning commission regarding potential noise levels from the theater’s two-building project at 413, 415 and 417 Rehoboth Ave. The report in question was submitted on behalf of a group of people who appealed, and won reversal of, the planning commission’s approval of the project back in August. City commissioners required the planning commission to conduct a second public hearing on the matter; the hearing was held Jan. 29. ....

Clear Space, theater complex opponents enter into mediation

In an effort to reach a consensus on how to move forward on a proposed Rehoboth Avenue theater complex, Clear Space Theatre Company and the appellants against the current plan have entered into mediation.
News of the planned mediation was revealed during a planning commission meeting Jan. 8. Commissioners held a brief discussion to make sure the things they needed to conduct a second round of public hearings were in order. The city’s planning body has been required to conduct the public hearings for the two-build complex at 413, 415 and 417 Rehoboth Ave. because city commissioners found the planning commission’s August approval of the proposed site plan was invalid. During an appeal hearing in November, city commissioners determined the public hearings in August shouldn’t have happened because Clear Space hadn’t provided all the required information in a timely fashion. ....

New year, new public hearings for Clear Space

While a specific date has not yet been set, members of the Rehoboth Beach Planning Commission unanimously agreed that all information required to conduct a second public hearing on Clear Space Theatre Company’s proposed Rehoboth Avenue theater has been submitted.
During a meeting Dec. 11, Planning Commission Chair Jeffrey Trunzo said he is still working with City Secretary Ann Womack to get a specific date, but he anticipates it to fall between mid-January and mid-February. There will be plenty of public notice, he said.
City commissioners have ordered the planning commission to redo the public hearings for the site plans of Clear Space Theatre, a 256-seat traditional theater at 415 Rehoboth Ave., and for Rehoboth Spotlight, a rehearsal theater at 417 Rehoboth Ave. The proposed construction of the two buildings has been a years-long process for Clear Space Theatre Company, which is currently located on Baltimore Avenue. ....
