Judge dismisses county lawsuit against Rocking R Bar over COVID restrictions

BOZEMAN — A lawsuit filed on behalf of Gallatin County against the Rocking R Bar in downtown Bozeman over adherence to emergency health orders was dismissed on Friday.
The suit was initially brought in response to the bar’s alleged, repeated violations of a 10 p.m. closing time rule put in place by the Gallatin City-County Board of Health due to the coronavirus pandemic.
In a signed order, Gallatin County District Court Judge Rienne McElyea said the case was now moot “.in light of actions of the Governor, the Board of Health, and the Health Officer.” ....

Gallatin County COVID-19 cases decline, MSU to vaccine over 800 students, faculty and staff


BOZEMAN, Mont. – The latest Gallatin County weekly COVID-19 surveillance report shows the county continuing to see a decline in cases while the county receives around 1,300 first-round vaccine doses per week.
According to Health Officer Matt Kelley, COVID-19 test results are being reported within a few days and contact tracers have consistently followed up with new cases within a day or two.
The total number of active COVID-19 cases as of Feb. 5 is 320 with five current hospitalizations and 51 total deaths.
On Thursday, the Gallatin City-County Health Board voted to allow businesses to extend their hours in the county.
Businesses can now remain open until 2 a.m. instead of 10 p.m. All other restrictions in the Phase Two of the Phased re-opening remain unchanged. ....

Gallatin City-County Health Board extends/amends COVID-19 local emergency health rules


BOZEMAN, Mont.- The Gallatin City-County Health Board reached decisions on all but one of their regular agenda items related to COVID-19 and emergency local health rules in just under five hours during their Wednesday morning meeting.
The first item on the regular agenda included discussion on an order from Montana Attorney General Austin Knudsen to dismiss their case against the Rocking R Bar for violating a 10 p.m. local closing time mandate.

The board voted 7-1 in favor of Health Officer Matt Kelley’s refusal to dismiss the case and directed County Attorney Marty Lambert to continue the lawsuit with Gallatin County Commissioner Joe Skinner the lone vote against. ....
