Chief Trial Assistant District Attorney Jason Rosenwasser said a large fight broke out inside the restaurant involving multiple patrons throwing bottles and other objects. Customers, including Murphy, began exiting. Murphy, Rosenwasser said, went to the car he drove that night and retrieved what appeared to be a semi-automatic pistol, clearly visible tucked into his waistband as he reentered the business. Rosenwasser said Murphy pulled the gun and said he was going to air the place out. A bouncer pushed him out the front door, Rosenwasser said, at which point Murphy fired the gun at Napoleoni from a distance of two to five feet, striking him once, as other patrons stood close by. ....

Desiree Nieves, 38, was arrested after allegedly breaking into a Middletown home and stealing multiple items, reportedly including a handgun. Nieves later failed to pay court-ordered restitution to her victim and a warrant was subsequently issued for her arrest by Orange County Court. Police described Nieves as being 5-foot-5 weighing approximately 135 pounds with brown hair and green eyes.
