Civil Rights Bill Sparks Fear Of Financial Calamity From Local Governments Across New Mexico

A civil rights bill that has sparked fears of financial calamity from local governments across New Mexico and ensnared the top-ranking Democrat in the state House of Representatives in an ethics complaint narrowly cleared the Senate Judiciary Committee on a 5-4 vote late Wednesday.
The committee chairman and Senate sponsor of House Bill 4, Sen. Joe Cervantes, broke a tie vote after a nearly 2 1/2-hour discussion and debate on the contentious measure.
“Do I see a 4-4 vote?” the Las Cruces Democrat asked the committee secretary just before 9 p.m. “I vote yes.” ....

Ten settlements were reached. Of those lawsuits, only one was filed in 2020. The rest were filed in previous years.

PORTLAND, Ore. In 2020, the city of Portland paid out $1.14 million in lawsuits filed against the Portland Police Bureau.
Ten settlements were reached. Of those lawsuits, only one was filed in 2020. The other nine were from previous years going back to 2014. Most of the cases had to do with use of force or discrimination claims.
One of the settlements was for $975,000 to the family of Lane Martin, who was shot and killed by police in 2019. His family filed the suit after a grand jury decided not to charge the officer who shot him. Martin’s family alleged in the lawsuit that he was experiencing a mental health crisis and was met with excessive force, OPB reported. ....

Local and state government agencies paid more than $1.2 million in penalties and legal fees in 2019 for failing to follow the state’s Inspection of Public Records Act, according to the New Mexico Foundation for Open Government.
But some of those legal fees and some of the penalties didn’t come out of the local government or state agency budgets. Instead, they were covered by insurance – something that has open government advocates concerned.
“By covering the costs for withholding documents, insurance gives those entities no incentive to comply with the law,” Santa Fe attorney Daniel Yohalem said in an interview. “They are withholding too many records because they figure the cost is free.” ....
