Advice on the cusp of a new RoA era | Professional Planner

Advisers are on the brink of swapping out lengthy statements of advice (SoAs) for shorter records of advice (RoAs) in more scenarios if recent signals from the regulator are consistent with their intentions.
On Monday ASIC provided high-level takeaways from its consultation on advice access (CP 322) to the government, with the two-page document headlined by the finding that advisers want to use more RoAs yet remained constrained by regulatory and licensee restrictions.
“SOAs are a clear cost barrier to providing limited advice,” ASIC stated after trawling through the 469 submissions it received – 244 from financial advisers.
“Respondents have raised that Government should reconsider the SoA requirements and expand the situations when an RoA is permissible instead of an SoA.” ....

Financial advisers are keen on regtech but don’t like digital advice according to ASIC, which provided feedback on its landmark consultation into affordable advice as part of a Parliamentary Joint Committee hearing held in March.
In response to a question from Liberal MP Bert van Manen that was taken on notice by Commissioner Danielle Press, ASIC published this week a series of observations about advisers’ views on technology.
The common view, ASIC reports, is a widespread reluctance among advisers to embrace investment technology solutions that fall under the ‘digital advice’ umbrella.
“There is very little appetite for digital advice among existing advisers,” ASIC stated after going through 469 submissions from advisers, licensees and other industry stakeholders. ....

The corporate regulator has been forced to explain the different independence disclosure obligations between asset consultants and financial advisers in a series of questions taken on notice by Commissioner Danielle Press at the Parliamentary Joint Committee on Corporations and Financial Services in November.
Liberal Party MP Jason Falinski hounded Press on the marketing of asset consultant Frontier Advisors, who provide investment advice to institutional clients like superannuation funds and insurers, as well as private wealth advisers.
“ASIC have rightfully made a lot of the term ‘independent’,” Falinski said.
