DIFC Courts sets up working group for 'Space-related disputes'


In statement, Zaki Azmi, Chief Justice of DIFC Courts, said: “While space law is nothing new, an important next step will be for the Courts of Space initiative to develop and establish the DIFC Courts as a commercial go-to court for these matters. This is a complex and tall order, but it’s well within Dubai’s reach as the UAE develops its own space-faring ambitions and becomes one of very few countries to have reached Mars.”
The 17-member Working Group will have observers from The United Nations Office for Outer Space Affairs.
“For the time being, the Working Group will discuss more current space dispute issues such as equipment failures, space cargo disputes, or even failure to deliver components on time, said Amna Al Owais, Chief Registrar, DIFC Courts. It might include substandard materials or design faults. ....

Dubai announced Monday the creation of a space court to settle commercial disputes, as the UAE - which is also sending a probe to Mars - builds its presence in the space sector.
 
The tribunal will be based at the Dubai International Financial Centre (DIFC) Courts, an independent British-inspired arbitration centre based on common law.
Space law is governed by international conventions and resolutions, including the UN Outer Space Treaty which entered into force in 1967. Several states have also signed bilateral or multilateral agreements to regulate their space activities.
However, while until recently the field was almost exclusively the domain of nations and institutions, space has become a commercial issue involving more and more private companies. ....

As more countries look to space, the prospect of diplomatic and/or commercial disputes in the cosmos is looking like a very palpable one.
Which is why something like the United States Space Force was created in the first place – to settle possible future conflicts beyond the domain of planet Earth. A seemingly outlandish idea at first that now seems not so crazy after all.
Now, the United Arab Emirates (UAE) has joined the party by creating a space court for settling commercial space-related disputes. On February 1, 2021, Dubai launched The Courts of Space initiative as a partnership between the Dubai International Financial Centre (DIFC) and the Dubai Future Foundation. ....
