PHOTO: IHC WEBSITE ISLAMABAD: The Islamabad High Court (IHC) has noted that the PTI government still has 2 years to rule and its decision to introduce the electronic voting machines (EVMs) or to bring about changes in the High Education Commission (HEC) should be routed through the parliament rather than through ordinances. “An ordinance can be passed only in an emergency situation when a law is needed to be imposed immediately and the parliament is not in session,” IHC Chief Justice Athar Minallah said on Wednesday as head of a division bench hearing a slew of petitions filed against PTI government’s ordinances. ....

SC scraps actions against Faez, family Top Story April 27, 2021 ISLAMABAD: The Supreme Court on Monday accepted identical petitions challenging its last year’s order of June 19 referring the matter to the Federal Board of Revenue with a direction to initiate tax proceedings against the spouse and children of Justice Qazi Faez Isa. A 10-member larger bench headed by Justice Umer Ata Bandial allowed the review petitions filed by Justice Qazi Faez Isa and various Bar associations against its order of June 19, 2020. Other members of the bench were Justice Maqbool Baqir, Justice Manzoor Ahmed Malik, Justice Sajjad Ali Shah, Justice Mazhar Alam Miankhel, Justice Muneeb Akhtar, Justice Mansoor Ali Shah, Justice Sajjad Ali Shah, Justice Qazi Muhammad Amin Ahmed, Justice Yahya Afridi and Justice Amin Uddin Khan. Five judges dismissed the review petition of Justice Qazi Faez Isa while five allowed it. The majority six to four set aside the last year’s June 19 order ....

The PTI led federal government on May 23, 2019 filed two presidential references and the SJC – the only constitutional forum that can hold a superior court judge accountable – had issued show-cause notices to both the judges –Supreme Court judge Qazi Faez Isa and Sindh High Court’s (SHC) Justice KK Agha. Justice Isa had challenged the presidential reference and the SJC proceedings in the apex court but Justice Agha had decided to face the SJC proceeding. However, the Sindh Bar Council (SBC) in its petition against Isa reference had also requested the court to quash the reference against Justice Agha. ....
