ACLU Files Promised Lawsuit Over Arkansas' Transgender Care Ban

The American Civil Liberties Union filed suit Tuesday against the state of Arkansas over a newly passed law that prohibits health care professionals from providing gender-transition procedures to individuals under age 18.
The lawsuit filed in the U.S. District Court Eastern District against Act 626 was filed on behalf of four transgender youth and their families along with two doctors. It alleges the law violates the U.S. Constitution.
Act 626 prohibits physicians and health care professionals from providing gender transition procedures to individuals under age 18, or to refer minors to other health care professionals. It also prohibits the use of public funds or insurance coverage for gender transition procedures. It does not prohibit services for persons born with a “medically verifiable disorder of sex development,” such as external biological sex characteristics. ....

The American Civil Liberties Union filed suit Tuesday (May 25) against the state of Arkansas over a newly passed law that prohibits health care professionals from providing gender-transition procedures to individuals under age 18.

ACLU files promised lawsuit against Arkansas's ban on gender-affirming care for transgender children

The
ACLU of Arkansas has joined families with transgender children and doctors in filing the promised lawsuit today against Arkansas’s new law to
prohibit gender-affirming care for transgender children.
The case was filed in federal court in Little Rock. The law had no emergency clause and doesn’t take effect until the end of July. The suit seeks an injunction against it taking effect.

The plaintiffs include four transgender children and their parents and two doctors who say the law prevents them from providing medically necessary care or even referring children to others. The law also prevents the use of state money (such as Medicaid) or private insurance coverage for this health care to people under 18. Defendants are Attorney General Leslie Rutledge, who’ll relish the spot as a backer of anti-transgender legislation, and the director and members of the state Medical Board.
