Najib and son fail to get Federal Court to hear constitutional issues in appeal concerning tax case

PUTRAJAYA (Bernama): The Court of Appeal on Wednesday (Aug 11) has disallowed an application by lawyer Tan Sri Muhammad Shafee Abdullah, appearing for Datuk Seri Najib Razak and his son Datuk Mohd Nazifuddin, to refer constitutional issues involving Section 106 (3) of the Income Tax Act 1967 to the Federal Court.

An exceptionally long SRC appeal hearing ends

However, the Court of Appeal yesterday reserved judgment until a date yet to be fixed. A three-member panel led by Justice Datuk Abdul Karim Abdul Jalil heard arguments from both parties over 15 days. “We thank all the parties involved. this hearing was exceptionally long compared to other appeal hearings, ” he said. “Since there were many important issues raised by both parties, we need some time to deliberate and to deliver our decision.” The other two judges on the Bench are Datuk Has Zanah Mehat and Datuk Vazeer Alam Mydin Meera. Jho Low won t dare to deceive Najib, says DPP

PUTRAJAYA (Bernama): Fugitive businessman Low Taek Jho (pic) or Jho Low would not dare to deceive Datuk Seri Najib Razak due to their good relationship, the Court of Appeal was told. Ad hoc prosecutor Datuk V. Sithambaram said it was too far-fetched that Jho Low, being in a position subordinate to the appellant (Najib), would have the audacity to orchestrate fraudulent transactions that would directly implicate the former prime minister. Sithambaram submitted this before a three-member bench led by Judge Abdul Karim Abdul Jalil in the hearing of Najib’s appeal against his conviction and jail sentence for misappropriation of RM42mil in SRC International Sdn Bhd funds.

Sithambaram today told the Court of Appeal that Datuk Seri Najib Tun Razak’s act in returning a portion of ‘Arab donation’ to an alleged sender without any explanation or a thank-you letter shows that the so-called Arab donation was a scam. He said that if the donation was from the late King Abdullah Abdulaziz Al Saud why should it be returned to a company called Tanore Finance Corp. “The King never asked for the money back. In fact, the appellant (Najib) said the money was donated by the Saudi King to ensure Malaysia can become the model of a stable and modern Islamic country.

PUTRAJAYA: The prosecution in the appeal filed by Datuk Seri Najib Razak has slammed his defence that a RM4bil loan was approved to SRC International Sdn Bhd in the name of national interest. Ad hoc prosecutor Datuk V. Sithambaram said it had been the mantra of the defence that the appellant, Najib, had supported the RM4bil loan and the government guarantee (GG) was for “national interest”. He was submitting the prosecution’s rebuttal at the hearing of the appeal filed by Najib against his conviction and sentence before a three-man panel of the appellate court here yesterday.
