　　法定刑以下判处刑罚规则适用的条件，包括实体与程序两个方面。前者要求案件具有“特殊情况”，后者要求经最高人民法院核准。“特殊情况”没有明确的法律规范，我认为，主要是对被告人的量刑是否符合“罪刑相适用”这一量刑基本原则。
