where people come inside for even a little bit. it seemed like, pete, some of the more conservative judges were sympathetic to the challengers. is that a good assessment? yes. there were two, one being the osha requirement, one where there s a company with more than 80 employees. the they re saying the government doesn t have the authority to do that for a couple of reasons. some of the justices thought it wasn t targeted, that it didn t make any distinction where people are spread out, or come in much and assembly workers are standing shoulder to shoulder. second, it s not a workplace thing. it s everywhere. how does osha get involved with the workplace. it s not just the workplace. the court seemed skeptical about that. now, the separate one, the
that the court then ruled that osha didn t have the authority, because covid isn t just a workplace thing. it s everywhere. everything. reporter: the government says, that isn t the limit of osha s authority. that osha isn t limited to hazards that crop up at work but can deal with things outside the workplace but that affect the workplace as well. secondly, if you look at the balance, they say, the down side to employers is not as bad as the down side to the country of not doing anything about covid, about not vaccinated or wearing masks. they say, lift the stay, or at the very least if you re not going to lift the stay entirely on enforcing the whole osha rule, at least let the government put the mask requirement into place, the first one that kicks in, in december. the vaccination requirement would come in january. this is the next round, but likely to be the last round or ultimately ending up at the supreme court? do you think. reporter: when you challenge
rob schmitt is on day 25 of the shutdown. you had a chance to see senator menendez with a shirt on. rob: with a suit on. and as we have been saying, this has been the kind of a workplace thing. there have been a lot of meetings and a lot of work is needing to be done down here. a lot of people are talking about this winter retreat that more than 30 democrats came to on a private charter they got put up in a fancy hotel. they got to bring their families. the food was all taken care of. it was very fancy. there is a lot to talk about here in puerto rico. they had a devastating hurricane in 2017. they have been living well beyond their means for a long time. that debt needs to be managed better. that was the discussion down here. but, there was also in addition to those meetings a lot of leisure time we caught bob menendez the new jersey senator on the beach and then we caught up with him yesterday in a suit. he didn t want to talk to us. take a listen. could have had hours and hours an
