Contract workers, who were suspended from work because they joined other workers seeking permanent jobs, have been reinstated.
Five contract workers at an Emalahleni mine, who were suspended from work because they joined other workers seeking permanent jobs at the Commission for Conciliation, Mediation and Arbitration, have been reinstated.
Labour High Court Judge Andre Van Niekerk has ruled that the company which employed them, cleaning contractor Sno Aluhle Projects and Services, acted unlawfully in blocking their access cards to the Kriel Colliery, effectively preventing them from working and earning.
The dispute between the company and the workers, Simphiwe Maseko, Bangile Ngcobo, Suzy Sibiye, Nomfanelo Zothane and Hanesworth Makile, began in December last year when they and two others joined more than 300 other contract workers at the mine in applying to the CCMA for their jobs to be made permane ....

Labour Court to hear appeal by 194 former Ekurhuleni Metro general workers

The Labour Court in Johannesburg is expected to hear an appeal by 194 disgruntled former City of Ekurhuleni employees.
The group was among many who were temporarily employed by the City in 2014, as part of the Lungile Mtshali Development Plan project.
They claimed that they were promised they would be provided with relevant skills, followed by permanent employment.
About 194 disgruntled former City of Ekurhuleni employees are taking the municipality to the Labour Court on appeal demanding permanent employment.
The group were employed by the City in 2014 on a year-long contract which expired in 2015.
They were employed as part of the City’s job creation programme called the Lungile Mtshali Development Plan project. ....

After an arbitration process that has taken more than two years to complete, the Commission for Conciliation, Mediation and Arbitration (CCMA) has ordered the reinstatement of 178 workers who had been fired from a paint manufacturing company in 2018. In addition, the workers were awarded back pay of about R38.2 million.

The company dismissed 181 workers, but only 178 will return to work as two have passed away and the other worker was sick when he was fired. He wasn’t part of the process that challenged the dismissal and he doesn’t want to go back. “When I saw that we won, I was over the moon and I am sure that this feeling is mutual for the other dismissed workers,” said Khongelani ....

Luxor Paints workers awarded R38 million by CCMA

The Commission for Conciliation, Mediation and Arbitration (CCMA) has awarded about R38-million in back-pay to 181 workers who were dismissed from a paint manufacturing company in 2018, and ordered their reinstatement.
The Boksburg company, Luxor Paints, has opposed CCMA commissioner Bonginkosi Zulu’s arbitration ruling of 13 January 2021, and has referred the matter to the Labour Court for review.
Under the Labour Relations Act, a Labour Court review means that the award is still implementable until the court’s decision is made, unless the company approaches the court for an exemption.
According to the CCMA’s ruling, 181 Luxor employees were dismissed after strike action that started on 26 February 2018 and continued until 5 March 2018. The first group of 111 workers were dismissed on 8 March 2018 and the second group of 70 workers were dismissed on 27 July 2018. In both cases the workers were dismissed for alleged misconduct during the protected strike. ....

Cape Town - Workers and trade unions are disappointed over the increased caseload at the Commission for Conciliation Mediation and Arbitration (CCMA) after news that part-time commissioners are no longer resolving disputes.
Casual Workers Advice Office (CWAO) organiser, Edgar Matome said that was a massive attack on workers in particular the unorganised, who were not members of trade unions or other organisations.
Matome said the backlogs benefit the bosses “because they would rely on the delay in cases to dismiss and intimidate workers knowing it would take years to resolve the dispute”. ....
