One of the 14 men charged in last year’s pre-election plot to kidnap and execute Democratic Michigan Governor Gretchen Whitmer dropped his extradition appeal in Wisconsin, was taken to Michigan and was briefly booked into the Antrim County Jail last Tuesday.
Brian Higgins, 52, is facing a 20-year felony charge after being charged last October with providing material support of an act of terrorism. Higgins is one of a group of right-wing militia supporters who have been charged in the plot to kidnap and kill the governor over her actions in enforcing an initial coronavirus lockdown a year ago. ....

A Wisconsin man who had been fighting extradition to Michigan to face charges that he plotted against Michigan s governor has dropped his appeal and was in custody in Antrim County on Tuesday.
Jail officials in Wisconsin and Michigan confirmed Tuesday that Brian Higgins, 52, of Wisconsin Dells, was moved late Monday. He was booked in the Antrim County Jail and was then arraigned Tuesday afternoon via video conference for the 86th District Court and sporting a striped jail outfit.
Higgins is one of 14 men charged in the case. ....

But shortly after issuing his ruling, Hepler agreed to stay the decision, saying that the public would not be at risk with Higgins in custody in Wisconsin while his appeal is heard. In fact, with Higgins still in custody, he has the most to lose with the delay, Hepler said.
I do not think Mr. Higgins appeal is frivolous under the circumstances, Hepler said.
An attorney for the state of Michigan, Assistant Attorney General John Pallas, was allowed to speak at the Wisconsin hearing and suggested an appeal could take one year, making the case more difficult for prosecutors because Higgins prosecution would be separated from the other kidnap-plot defendants charged in state court. ....

One of the men charged in the plot to kidnap Michigan Governor Gretchen Whitmer lost a battle challenging his extradition on Tuesday, but the judge agreed to stall the decision while his appeal is being heard.
On Tuesday, Brian Higgins of Wisconsin Dells, Wisconsin, argued that his extradition paperwork should be invalidated because Whitmer was the one to sign it.
Higgins attorney, Christopher Van Wagner, said that because Whitmer is the reported victim of the plot, she is a conflict of interest who should not be able to extradite Higgins to Michigan. ....
