1 Min Read A federal appeals court on Wednesday once again revived a breach of trust claim filed in 2003 by the Navajo Nation, alleging that the U.S. Department of the Interior has failed to secure adequate water for reservation lands in Arizona, New Mexico, and Utah. The 9th U.S. Circuit Court of Appeals reversed a ruling by a federal judge in Prescott, Arizona, who said the Navajo Nation had not identified any source imposing such a duty on the Interior Department or its Bureaus of Indian Affairs and Reclamation. 1 Min Read Environmental groups sued the Bureau of Land Management in federal court on Tuesday, alleging that the agency unlawfully authorized an Idaho phosphate mine project by a subsidiary of Bayer AG because it didn’t account for the increased selenium pollution it may cause in waterways. The Center for Biological Diversity and others alleged in U.S. District Court for the District of Idaho that BLM violated the National Environmental Policy Act by failing to take a “hard look” at how dust of selenium, a mineral toxic in high concentrations, that would be released at the proposed Caldwell Canyon open-pit mine in southeast Idaho could contaminate the nearby Blackfoot River. The mining project by Bayer’s P4 Production LLC, would produce phosphate that the complaint says the German chemicals group would use to manufacture the active ingredient in its weedkiller Roundup. ....
1 Min Read A federal appeals court on Tuesday threw out a district court’s injunction won by a Nevada doctor won against a Medicaid contractor he had accused of repeatedly denying his claims on the same incorrect basis, finding that the doctor was required to present each disputed claim to the Department of Health and Human Services. The unanimous 9th U.S. Circuit Court of Appeals panel found that, although U.S. District Judge Richard Boulware in Nevada had found it would be impractical for the doctor, Robert Odell, to administratively appeal each individual claim when the contractor had shown a pattern of denying them improperly, the federal Medicare statute did not give courts jurisdiction to review claims that had not gone through administrative appeal. ....
Former New York AG Eric Schneiderman is suspended for abusing women

(AP Photo/Richard Drew) Former New York Attorney General Eric Schneiderman will be suspended from law for one-year for physically abusing two women during long-term relationships and a third woman, a lawyer, during a romantic encounter. Schneiderman agreed to the suspension, according an April 27 opinion imposing discipline by the New York Supreme Court, Appellate Division. The suspension is conditioned on Schneiderman continuing treatment with his mental health professional and supervision by the New York City Bar Lawyer Assistance Program. According to stipulated facts cited in the opinion, Schneiderman placed his hands on the necks of the two women with whom he was in long-term relationships “and applied pressure without obtaining consent.” He also slapped the women and was verbally and emotionally abusive toward them. ....
