I want to dig in deeper on this sort of plain text of the language issue and alito focusing on at least the housing case, you just look at the plaintext of the law as it was written in 1968. And if the plaintext of the lot as it was written in 1968 did it mean to include the disparate impact, you cannot include disparate impact. But in opposition to that justice, it went to a very prolonged discussion about the fact that you look at the law holistically. If you look at the law in all of its elements when you are trying to determine whether or not there was a statutory intent for whatever the question is. And i think that is important, going back to the point that was made earlier because in my mind if scalia votes against disparate impact, he is going against the president has event that he is has already set forth, the believe he is already set forth in the does rai
