However, a pair of Senate Democrats recently released proposed legislation to reform the nation’s unemployment system that includes a hidden “nugget” – requiring states to use the restrictive California version of the ABC test for purposes of determining eligibility for unemployment insurance benefits. A bill introduced in the U.S. Senate last week would provide up to $250 in weekly unemployment benefits to gig workers.
Sens. Ron Wyden, D-Oregon, and Michael Bennet, D-Colorado, introduced the Unemployment Insurance Modernization Act. The 106-page bill seeks to overhaul current unemployment insurance benefits, allowing them to fluctuate in amount and length during times of high employment, among other changes. It would also codify jobless benefits to workers who quit for certain reasons, such as the loss of child care. ....

Two Senate Democrats on Wednesday introduced legislation to overhaul the nation’s unemployment insurance system after the coronavirus exposed flaws in the existing structure.
The sweeping proposal sponsored by Sens. Ron Wyden of Oregon and Michael Bennet of Colorado aims to raise base benefits, create a permanent benefit for self-employed and gig workers, minimize differences between state programs and tie extended benefits to the unemployment rate.
The draft bill, titled the Unemployment Insurance Modernization Act, would require all states to offer at least 26 weeks of benefits and replace 75% of a worker’s typical wages up to a set maximum. ....

Senate Bill Would Expand Unemployment Benefits and Pay $250 a Week to Gig Workers


The bill, the Unemployment Insurance Modernization Act, would also make the self-employed, gig workers, new graduates and others a permanent fixture of the unemployment safety net.
Such workers, who are typically ineligible for state aid, would qualify for a $250 weekly Jobseeker Allowance benefit, paid by the federal government for up to six months and indexed annually for inflation.
The amount and length may increase during times of high unemployment. Similarly, state benefits would also be more responsive to economic downturns and rising joblessness.
It makes other tweaks, too. For example, states wouldn t be able to deny jobless aid to workers who quit their job for compelling reasons, like the loss of childcare or unusual risks to health or safety, and irregular work schedules all of which have come into play during the pandemic. ....
