Dozens of people gathered at the Bath Township Trustee building in Fairborn Wednesday night to protest the controversial bio-waste operation on Herr Road owned by Central Ohio-based Renergy Inc. The protestors said they know their opposition will be a marathon, not a sprint.
Last week, Greene County Court of Common Pleas Judge Michael Buckwalter ruled that the Bath Township biodigester is a public utility, because it creates a small amount of green energy. That makes it exempt from local zoning rules, per Ohio state law. Township trustees said earlier this week in a Facebook post that they would filed a motion to appeal the decision. ....

FAIRBORN The Fairborn City Council has penned a letter of concern to the Ohio Environmental Protection Agency, citing concerns from residents about the Dovetail biodigester.
The letter, dated Friday, Feb. 26, is addressed to Laurie Stevenson, Ohio EPA Director and signed by the mayor and each member of the Fairborn City Council. The letter concerns the long-embattled Dovetail biodigester facility, located on Herr Road in Bath Township.
Residents of both Bath Township and Fairborn have long raised concerns about the facility and the odor that is alleged to emanate from it. ....

Latest court filings dispute Bath biodigester’s utility status

BATH TOWNSHIP The latest court filings in a lawsuit regarding the Bath Township biodigester dispute claims that the facility is a public utility.
The Bath Township Board of Zoning Appeals (BZA) filed a response to Dovetail Energy’s Notice of Supplemental Authority on Feb. 18, stating that Dovetail’s argument that it is a public utility is erroneous.
In its response, the township asserted that Dovetail’s operation does not meet the agricultural use exemption under the Ohio Revised Code. According to court documents, a biomass energy facility is exempt from zoning regulations if “at least 50 percent of the feedstock used in the production was derived from parcels of land under common ownership or leasehold.” ....
