This is a state law that can only be challenged in texas state court. remember, brian, this texas law has this bizarre provision that sets up private citizens as essentially bounty hunters, anyone who sues an abortion provider under this law gets their legal fees paid and $10,000 if they win. but because the ban on abortion is enforced only by private citizens, texas says the justice department can t sue because it s the regular citizens, not the states, who are enforcing that law. and very quickly, the department of justice responded today and said it s not about states rights because the texas law violates roe vs. wade. the argument is if texas is allowed to get away with this, no constitutional right is safe because any state can sabotage it in the same way. jackie, finally because you ....
