Woman says she was a victim of racial discrimination, retaliation by Lowe's


HUNTINGTON – A Cabell County woman claims she was a victim of discrimination and retaliation by Lowe’s Home Centers.
Mary Clayborn filed her complaint in U.S. District Court against Lowe’s, saying the North Carolina-based retailer failed to comply with the Family and Medical Leave Act of 1993, the West Virginia Human Rights Act and state laws.
In its answer to the complaint, Lowe s denies the allegations.
According to her complaint, Clayborn began working for Lowe’s in 2015 as a sales associate. She says she was the only Black female where she worked.
In May 2018, she says a white assistant store manager began picking on her and another Black employee. She says she promptly reported the harassment to store managers and to corporate. ....

Supreme Court says Blue Cross case should be dismissed for lack of jurisdiction

CHARLESTON The West Virginia Supreme Court of Appeals granted a writ of prohibition to prohibit the enforcement of a March circuit court order that denied a motion to dismiss for lack of personal jurisdiction.
The Supreme Court ruled that Blue Cross Blue Shield was entitled to the writ of prohibition, vacating the order from Judge Shawn Nines, presiding judge of the state s Business Court Division, and denying their motion to dismiss for lack of personal jurisdiction.
Chief Justice Tim Armstead authored the majority opinion. Justice John Hutchison dissented and authored a separate opinion.
In this original jurisdiction proceeding, Petitioners, out-of-state Blue Cross Blue Shield Plans . ask this Court to prevent the enforcement of the circuit court’s March 27, 2020, order, and to grant the requested writ of prohibition dismissing them from the underlying civil action for lack of personal jurisdiction, Armstead wrote.
