Up until 1950, we did have it on the census. The census changes and we didnt ask that question. Tell us about the posture of this case and this police judge, jesse furman. Laura what is happening here is that these judges are, you know, taking these cases and imposing their own judicial philosophy and new standards that are not written into the law into these cases. You saw the exact same reasoning that judge furman used here, which is that wilbur ross, in charge of the census in his department, had made some remarks about the reasoning behind wanting to count citizens that raised an issue of animus. Well the United States Supreme Court recently ruled that this Animus Theory is bogus and one of the elements that shouldnt be applied. Clarence thomas has spoken out on nationwide injunctions.
